Order of the Ministry of Infrastructure of Ukraine № 541 dated 18.12.2015
On Approval of Tariffs for provision of services for access to the Port Operator to the Berths, which are under control of the economic management of the administration of the sea ports of Ukraine.
UGA made a suggestion not to cancel and not rule out a lowering factor of 0.7, which is foreseen by the current edition of the order № 541 dated 18.12.2015
Cabinet of Ministers of Ukraine by Resolution № 483 of 07.07.2015 supplemented a list of specialized services provided in seaports, a new service – providing access to the port operator to the berth, which is under the economic management of the Administration of the Sea Ports of Ukraine. Ministry of Infrastructure (hereinafter – the Ministry) by its Order № 541 dated 18.12.2015 approved the appropriate tariffs for this service.
So, port operators that overload grain cargoes in bulk at specialized terminals using boat loaders with a productivity of 500 tons per hour and more, received the right to use a lowering factor of 0.7 when calculating the cost of the relevant service.
The Law of Ukraine “On sea ports of Ukraine”
Law amended the Code of Merchant Shipping of Ukraine, including the regulation of pilotage services. The changes to the Code abolished the monopoly of state-owned enterprises for the provision of pilotage and pilotage services in the field of merchant shipping, creating conditions for the establishment of pilot enterprises of private ownership.
UGA addressed a letter to the Ministry of Infrastructure of Ukraine asking them to accelerate the preparation of draft amendments to the existing regulations governing the provision of pilotage services.

One of the main ideas of the draft law is the introduction of international practices to attract the private sector to provide product selection services and conduct phytosanitary expertise.
UGA has supported the draft law.
According to the current edition of the Customs code of Ukraine, officials of the State fiscal service of Ukraine have the right to select grain samples during the export of goods outside the territory of Ukraine until the time when the grain is loaded on a vehicle. The duration of the sampling and examination may take more than 30 calendar days, which leads to a slowing down of the work of the sea terminals, the spending of significant funds by exporters due to the ship’s idle time, the payment for the storage of the goods and the payment of fines for the untimely delivery of the goods.
UGA proposed to reduce the period of examination of grain samples by officials of the State fiscal service of Ukraine during the export of goods from the territory of Ukraine from 30 days to 1-2 days.

Draft Order of the Ministry of Agrarian Policy and Food of Ukraine
Adoption of the proposed Project will lead to a restriction of competition between market participants. The order places the port grain storages in a privileged position on the formation of export grain batches.
UGA did not support the draft Order and proposed to expand the list of elevators, which will be allowed to form export batches of grain and include in this list linear elevators.
